แถลงการณ์ร่วม 4 องค์กรสื่อ
เรื่อง การเสนอข่าวที่เป็นการละเมิดสิทธิส่วนบุคคล
ตามที่สื่อมวลชนบางส่วนได้นำเสนอภาพ และข่าวเกี่ยวกับคดีอาชญากรรมหลายคดี ที่มีลักษณะเข้าข่ายละเมิดสิทธิส่วนบุคคล และศักดิ์ศรีความเป็นมนุษย์ อีกทั้งเป็นการซ้ำเติมผู้ตกเป็นเหยื่อและญาติพี่น้อง โดยคดีฆาตกรรมนักท่องเที่ยวชาวอังกฤษที่เกาะเต่าเป็นกรณีตัวอย่างล่าสุด ซึ่งทำให้เกิดเสียงวิพากษ์วิจารณ์ต่อการทำหน้าที่ของสื่อมวลชนไทย ทั้งในสังคมไทยและต่างประเทศอย่างที่ไม่เคยเกิดขึ้นมาก่อน องค์กรวิชาชีพทั้ง 4 อันประกอบด้วย สภาวิชาชีพข่าววิทยุและโทรทัศน์ไทย สภาการหนังสือพิมพ์แห่งชาติ สมาคมนักข่าววิทยุและโทรทัศน์ไทย และ สมาคมนักข่าวนักหนังสือพิมพ์แห่งประเทศไทย จึงมีความกังวลอย่างมากต่อการวิธีการรายงานข่าวในคดีอาชญากรรมของสื่อที่มิได้เป็นไปตามมาตรฐานหลักจริยธรรมที่ให้ความเคารพในสิทธิส่วนบุคคลและศักดิ์ศรีความเป็นมนุษย์ ตลอดจนผลกระทบที่มีต่อเหยื่อและครอบครัว
การเสนอภาพและข่าวอาชญากรรม เป็นเรื่องละเอียดอ่อนอย่างยิ่ง และจำเป็นต้องพิจารณาถึงผลกระทบที่มีต่อผู้ตกเป็นเหยื่อและครอบครัว การเสนอภาพของเหยื่อในคดีอาชญากรรม ในสภาพอเนจอนาถ และการเปิดเผยรายละเอียดเกี่ยวกับสภาพของเหยื่อและข้อมูลส่วนตัวที่ไม่จำเป็น ถือได้เป็นว่าการกระทำซ้ำต่อเหยื่อและยังก่อให้เกิดความรู้สึกสะเทือนใจต่อครอบครัวของผู้ตกเป็นเหยื่อด้วย เพราะฉะนั้น สื่อมวลชนจึงพึงต้องระมัดระวังในการนำเสนอภาพและข่าวในลักษณะดังกล่าว และควรต้องให้ความเคารพต่อผู้ตกเป็นเหยื่อและความรู้สึกครอบครัวเป็นอย่างยิ่ง
การที่เอกอัครราชทูตจากสหภาพยุโรป 8 ประเทศ ได้เข้าพบกับองค์กรสื่อไทยเมื่อวันที่ 22 ตุลาคม 2557 พร้อมยืนหนังสือเพื่อแสดงความเป็นห่วงต่อการเสนอข่าวของสื่อมวลชนไทยในคดีฆาตกรรมที่เกาะเต่า โดยเฉพาะในส่วนที่เกี่ยวกับการละเมิดสิทธิส่วนตัวของเหยื่อและกระบวนการสืบสวนสอบสวนของเจ้าหน้าที่ ย่อมเป็นการแสดงให้เห็นว่าบทบาทของสื่อไทยปัจจุบันมิได้ถูกเฝ้ามองจากคนในสังคมไทยเท่านั้น แต่ยังถูกตรวจสอบจากภายนอกด้วย
เพราะฉะนั้นจึงขอเรียกร้องให้สื่อมวลชนไทยแสดงถึงความตระหนักต่อการทำหน้าที่โดยยึดหลักจริยธรรมแห่งวิชาชีพอย่างเคร่งครัด เพื่อให้สังคมได้รับข้อมูลข่าวสารที่ครบถ้วนและเป็นธรรม และในขณะเดียวกันสิทธิส่วนบุคคลและศักดิ์ศรีความเป็นมนุษย์ของผู้ที่ตกเป็นข่าวได้รับการปกป้องด้วย
อนึ่งองค์กรวิชาชีพทั้ง 4 องค์กร จะดำเนินการให้มีการหารือและแลกเปลี่ยนความคิดเห็นในวงการสื่อสารมวลชนเพื่อร่วมกันกำหนดแนวทางในการยกระดับการทำหน้าที่ของสื่อให้มีมาตรฐานมากยิ่งขึ้นเพื่อให้ได้รับความไว้วางใจจากสังคมมากขึ้น

Joint Statement of four Thai Media Organizations on the Media’s Violation of Individual Rights to Privacy and Fair Treatment in Reporting
Some media’s publication of photos and crime news stories that appeared to have violated the victims’ rights to privacy and affected the feelings of the victims’ family and relatives in the recent murder case of two British tourists on Koh Tao has sparked criticism from both domestic and international society on the role of Thai journalists in covering such crime stories.
Four Thai media organizations; namely, the Thai Broadcast Journalists Association, the News Broadcasting Council of Thailand, the National Press Council of Thailand, and the Thai Journalists Association, would like to express deepest concerns on the procedures of reporting crime stories by some of Thai media that seems to have violated the victims’ rights and caused greater sorrow to the victims’ family and relatives.
The effect that may cause to the victims and family should be highly considered prior to the publication of photos and crime news, as it is a very sensitive issue.
The publication of graphic pictures of the victims and dissemination of personal information can have traumatic impact on the feelings of the family of the victims. Therefore, media should be cautious in disseminating such photos and news stories, and should respect the feeling of the victims’ family.
The meeting between eight European Union Ambassadors with representatives from the four Thai media organizations coupled with the submission of a letter expressing concern on the reporting of Thai media with regards to the violation of victims’ rights and the investigation procedures of Thai officers with the recent murder case on Koh Tao were examples of evidence that Thai media are being monitored by not only Thai society but also the international community.
Hence, the four Thai media organizations would like to call on all Thai media to strictly follow the current codes of ethics in reporting for the society will benefit in receiving the correct and fair information that does not violate individual rights of the victims.
The organizations will further hold discussion and exchange ideas on the roles of the media in reporting in order to determine the right model for reporting and uplift the standards of Thai media to gain wider public trust.
